I understand that...but charge him as an adult, for such a tiny worthless crime such as a carrying a lighter/knife? It's possible...but...I don't know...

Like I was saying, most schools count automatic knives as serious a crime as bringing a gun to school. It's a serious offense...it really is

yes i admit, im a dumbass for not realizing i had it on me.

jd is right. you have to remember. on school grounds its zero tolerance to bring any weapon to school. and the weapon is illigal to own in the first place so ya.

for the 2 of you that are "calling bullshit" on this...all i have to say is

A. why would i make up a lie like this?
B. you keep saying that 17 wont be tried as an adult...read tx. state laws.
C. you say its not a big deal, look at it in the courts way "kid brought a weapon to school, probably was going to kill someone"
D. if you dont believe me i dont care. this isnt for pitty, im doin this because i want help w/ the case and so far some people have given me a few ideas like the 4th amendment one.

and the thing about the cop not reading me my rights, someone said that since he didnt ask me anything it didnt matter. well i thought if your arrested you HAVE to have your rights read to you?

im praying thats right, cause thats my main chance of getting outa all this.

I think they have to read your rights before doing anything... Thats what happens on TV :D

Well thats kind of a lame excuse spirit lol. Last time I checked, when its something like that your rights aren't really that important because you aren't in enough trouble for it to really help you to claim that. I don't know....5 grand is one of the cheapest bonds you can get, which means your crime isn't that big a deal to them =\

Okay let me be a mature adult here.

1. You can be place under arrest and your rights not read to you if the officer does not ask you any questions after you was arrested.

2. As stated you consented to the search and willingly emptied your pockets to be searched. The rules of evidence is consistent from state to state as they is a federal law about it. In the state of Ga numerous places, schools being one of them, that once you willingly enter you waive your right to be checked for dangerous weapons.

3. Quit asking for advice on a board. Tell the court you want a lawyer and you cannot afford one. one will be appointed. A class III felony upon conviction will result in you losing several rights by law.

4. Unless you have the required lisc...never take a weapon of any kind to school or any public gatherings. Know the laws in your state.

jajaj well thanks for the luck man. but im not as you say "asking for advice on the board" i was just talkin bout my incident which turned out to have some positive feedback. but ya ive already got a lawyer, and theres no way in hell im gettin a court appointed lawyer "whatd you do? ok, *walks into court* he did it, arrest him judge" -.-

but ya thanks for bein a "mature adult" about it :D its a refreshment from spamming newb's (that doesnt address everyone so no offince ment)

uhh, u said this was on the bus right? unless it was a school bus,(we have city buses here) they really cant do anything cuz thats not school property but public property.

BUT the fourth amendmant says there can't be any unreasonable searches and seizures (spelled wrong) without a probubal cause. That means they can't say "You smell like pot. I'm gonna search your bookbag." Thats unreasonable. Last year in November a school was raided and the children had guns pointed to their heads. The police searched them b/c they THOUGHT that the students were dealing drugs. This is unreasonable and definatly crazy. The police found 0 drugs on that day, not even a cig. Back to ur case, they can't search you without you doing something wrong. You had to have committed a crime or something. ALSO they were looking for weed in your pockets now a knife right? So they weren't necessarily looking for a dangerous weapon on school grounds.

Hun you got urself a serious case!

On ABC was that story about a school that was raided for drugs. They said it was unconstitutional and parent sued.

YOu know skull,, if they didnt mirandize you, you can sue them big time. THats the thing where they read u "u got tehr ight to remain silent" bullcrap anyways......my advice is to take that crap out of ur pockets next time......or hide it in some obscure corner of ur backpack. God knows I bring my zippo to schooll all the time.....havent burned anything down yet, but was tempted a few times.

yknow dragnskull...depending on your record, you can just say it was a misunderstanding, and then you accidentally left it in your pants. like i said, depending on your record, you should get off with something like a warning.

wow watch out guys...drgn might cut ya...dude that sux isn't jail the worst thing ever? At least when i go to jail im so obliterated that i get to sleep the first few days off before i post bail. damn thats goin to hurt ya in the long run.
