You CAN get charged as an adult...but that's usually only for more serious crimes...

You can and will get arrested...even as a child. Even for stupid stuff, you just normally don't go to your standard jail, you get sent to juvy =\

I don't think having a lighter should be evidence against you because you can use it to smoke cigarets(which are not illegal).

The Fourth Amendment applies to public school officials. This is only the beginning, because the Fourth Amendment demands that searches be reasonable, and we hold that the search conducted here was reasonable even though there was no warrant or probable cause. The warrant requirement is unsuited to a school, where swift and informal procedures are needed to maintain discipline. We hold today that school officials need not obtain a warrant before searching a student under their authority. In the school setting not even probable cause without a warrant is required to conduct the search. This is not inconsistent with past decisions which have held that some types of searches are justified based solely on suspicion, a level of proof less than probable cause.

Lighter as Evidence?

And if the lighter is being held as evidence against you, it can't be, becuase it was ontained illegally and therefore violartes your right once again. (even if it isnt used against you). if you need me to get this court case too, to show you proof then i am more then willing to do so.

I'm calling bullshit on this one.

I was cought with a 3inch blade switchknife with me and only got suspended and fined 500$. It's against school policies (yes, all over the US as far as I know) to not let kids bring that in and get all that shit charged against them. If the blades smaller than your palm, it's technically legal...Well, it's still illegal, but you don't get in much trouble for it. No way in hell would you get a 5000$ fine and a day in prison, on top of getting charged with a 3rd degree felony and charged as an adult

Note: I've asked a few of my friend from all over the states and they have said the same smaller than palm, suspended for 10 days, 500$ fine thing...so yeah, whatever.

Edit: Unless you attacked one of them with it..

First off. im -not- lying. the blade on the lighter was roughly 1 1/2 - 2 in. long, i really did get a 3rd degree felony, and a 5k bond set. although we used the bonding company and only paid 10% of the actual bond, which roughly hits around 500 bucks (we had to pay tax and whatnot)

if you think im BS'n you then fine think what you like, i wish i was joking but im not.
and as for the whole "you cant be tried as an adult" read the tx laws. being 17 means in the eyes of law punishment, your an adult.

the ciggerette thing...uh...ya there legal to smoke, but only if your 18

First they said they were going to search me, then they searched my backpack, then they asked me if i would empty out my pockets, and i didnt know i had anything on me so i willinigly did so, and pulled the lighter out. then they patted me down.

but im still sticking w/ the whole thing w/ the cop...
he arrested me, and sat me down and said "by the way, your under arrest now, if you try to do anything im allowed to use any force neccessary to take you in"

but he never read me my rights


o and the lighter, you push the button like u said to bring the blade out, but you have to push it back in to close it, it doesnt auto-contract w/ the push of a button.

and no, i didnt attack anyone with it.

my guess on what ill get: 1 yr probation + community service.

and it wasnt prison, it was jail.

i dont know what to do to prove msyelf to you...i mean im telling you all this info...i can tell you what jail i went to, how many hours i was in, what shade of orange the ****in suites are, my bond, my bond company, my bond, the exact wording of my charge "carrying prohibbited weapon in prohibited place" (AKA Carrying switchblade at school)

i dunno what more you want, but ya if u dont believe me then fine...but while your sitting here sayin im full of shit...im hoping other ppl are givin me more info on this cause sounds like some of them got info that could help me.

and as u said "soemthing as little as this"

its not really a "little" thing.
illigal weapon (switchblade)
17 (considered adult, which = more punishment)
school grounds (illigal just to bring a weapon of any type even if it were a regular pocket knife)

Yea dude school is bullshit. I got suspended for two days for ****ing gambling, me and 3 other kids were playing texas hold-em with ****ing quarters, and we got caught and got suspended.

In most states, switchblades are illegal PERIOD unless you have a concealed weapons permit, the same permit you need to carry a gun. They are illegal to minors period, permit or not. I'm not even allowed to show minors switchblades, even with parent concent in my state (KY). The laws over there may be different, I don't really know...but over here, any automatic knife, no matter if the blade is in the mm, is illegal without that damned permit.

And BTW, I sell those too...

If the police officer did not ask you any questions, he has no need to read you your rights.

Sounds like all he did was arrest you and state you was going to the jail...one way or another.

If you had any raising you would have worn clean clothes and knew what you had in your pockets.

That being said....I call bullshit on this also.

Being tried as an adult is the ****ing courts decision. They base it on your age and what you did. So if they find out that you are 1 year away from being legal, and you committed a felony, obviously they will try you as an adult. They have tried 13 year old kids as adults in murder cases and shit like that before.
