Is this legal?

I was searching eBay and i came across this:

I emailed the guy asking him if he had permission from Zoid and Mousepad to be selling their material and this is what he said:

"LOL. All Battle.net hacks are "illegal". None of these guys can do ANYTHING about this auction... Please try...

*YOU GUYS ARE ALL JOKES*"

You guys can try contacting him... should this be brought to Zoid's and Mousepad's attention?

Its illegal to sell some1 stuff without there permission, as z0id/other ppl is the creator of it, he probably could sue them.

It´s ****ing stupid to sell program/modules made by others and without permission.

And it´s illegal if even one of the creators will state that those are only for educational purposes.

Go report that guy to Zoid/MH Creators, see if they do anything. If anything, it's a copyright infrigement- which is fraud.

And not only that but reading the Diablo 2 and Diablo 2 LoD terms of agreement, it is against that pact/contract to run or use any programs not allowed so by the realm. I.E. hacks/mh/pindlebots ect.

They wouldn't be able to sue b/c what they did was illegal in the first place technically if used on closed realms. They could sue for copyright infringement and such, but only if they market that the programs are for use on open b.net and single player games.

just because something is not legally copyrighted doesnt mean that it cant be copyrighted. as long as you put 'copyright 2004' it is legally binding that it is copyrighted, even if you dont put the copyright you can still sue ppl for using your own creations.

making a hack for a game is legal, but using the hack isnt.
