Save the replay, take some certain screenshots of evidence about the hacking, then e-mail Blizzard and attach the replay along with the screenshots, and explain your case. Be sure to include your username as well as the user in question.

I just take the loss.. if i lose to a hacker there's nothing i can do about it unless i am playing on a private ladder.

Dude, take the loss or report them. Just remember that that person needed hacks to kill you, capisce? Listen, don't let the hacks get to you and don't download them, most of them have trojans. So, just take the loss, or kill them!
